1. Overview
RallyUp is a platform designed to help companies increase employee engagement on LinkedIn by enabling participation in content challenges, gamified leaderboards, and performance analytics. These Terms apply to all users, whether you are a company administrator, employee participant, or guest visitor.
2. Eligibility and Account Responsibilities
- You must be at least 18 years old to use RallyUp or have permission from your employer if using it as part of a company program.
- You are responsible for maintaining the confidentiality of your account credentials and all activity that occurs under your account.
- You agree to provide accurate and up-to-date information when creating or updating your account.
3. Acceptable Use of the Platform
You agree to use RallyUp in accordance with all applicable laws and company policies. You must not:
- Use RallyUp to post or share content that is illegal, defamatory, harassing, or discriminatory.
- Attempt to gain unauthorized access to our systems or data.
- Interfere with or disrupt the functionality, security, or integrity of the platform.
- Use the platform to impersonate another person or misrepresent your affiliation.
4. Company Accounts
If you are using RallyUp as part of your company’s engagement program, your employer may administer your account and access engagement metrics, performance scores, and other participation data. RallyUp is not responsible for how your employer uses this data internally.
5. Content Ownership
- You retain ownership of the content you share or create on RallyUp, but grant us a limited, non-exclusive, worldwide license to display, distribute, and promote your content as part of the Services.
- Company administrators may create engagement challenges or campaigns that include company-owned content. RallyUp assumes no ownership or liability for such materials.
- You agree that any content posted through RallyUp to LinkedIn or similar networks complies with their respective terms and community standards.
6. Subscriptions and Payments
Some RallyUp features may require a paid subscription. All billing and subscription details are managed through secure third-party payment processors (such as Stripe). By purchasing a subscription, you agree to the pricing and renewal terms presented at checkout.
7. Termination of Use
We reserve the right to suspend or terminate your access to RallyUp if we believe you have violated these Terms or engaged in fraudulent, abusive, or unlawful activity. Upon termination, your access to account data and services will be revoked.
8. Limitation of Liability
RallyUp and its affiliates are not liable for any indirect, incidental, or consequential damages resulting from your use or inability to use the platform, even if we were advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you (if any) in the past 12 months.
9. Changes to These Terms
We may modify or update these Terms at any time. Updated versions will be posted on our website, and continued use of RallyUp after updates constitutes your acceptance of the new Terms.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions. Any disputes will be handled in the courts located in Montreal, Quebec.
